License Agreement

Please read the following License Agreement carefully using the scroll bar to view the entire Agreement. You must agree to the terms of this Agreement before downloading and using the Power Vision Program.

Power Vision Program (R) License Agreement By downloading, installing, copying, or otherwise using the Power Vision Program, you hereby agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, you are not permitted to download, install, copy, or otherwise use the Power Vision Program. 1. Definitions. You acknowledge and agree that the Power Vision Program is an educational program of vision improvement consisting of various techniques contained in an instruction manual and audio files. It is not a medical device nor a substitute for diagnosis or treatment by an eye doctor. 2. Exclusive Ownership. You acknowledge and agree that the Power Vision Program is the exclusive property of the American Vision Institute, including all ownership rights, intellectual property rights, trademark, copyright, and title. The American Vision Institute reserves the right to revoke all licenses granted hereunder at any time and without prior notice. 3. Personal License. You acknowledge and agree that if you are an individual, the American Vision Institute, hereby grants you the right to download the Power Vision Program onto your computer for your personal use. You are permitted to make one hard copy of the instruction manual and transfer the audio files to a CD or other portable media player for your personal use. 4. Professional License. You acknowledge and agree that if you are a health care professional, you are permitted to make unlimited hard copies of the Power Vision Program and freely give them to your patients. You are not permitted to sell the Power Vision Program, or modify it in any way, or create derivative works. 5. Business License. You acknowledge and agree that if you are a business, you are permitted to make unlimited hard copies of the Power Vision Program and freely give them to your employees. You are not permitted to sell downloads or hard copies of the Power Vision Program, or modify it in any way, or create derivative works. 6. News Media License. You acknowledge and agree that if you are a news media business, you are permitted to use excerpts from the Power Vision Program in stories, articles, and broadcasts, provided you give full credit to the American Vision Institute and prominently display their website (www.visiontherapy.net). 7. Supervision of Eye Doctor. You acknowledge and agree that before using the techniques contained in the Power Vision Program, you must first have your eyes examined by an eye doctor and you must only use the Power Vision Program under the supervision of an eye doctor. 8. Limitation of Liability. You acknowledge and agree that it is your sole responsibility to determine if the Power Vision Program is suitable for your intended purpose and by so doing, you agree to hold American Vision Institute and its officers harmless from any and all liabilities, losses, actions, claims, or damages that may arise from your use of the Power Vision Program or from any violation of this agreement. 9. Disclaimer. You acknowledge and agree that the Power Vision Program is provided to you “as is”, with no claims or warranties of any kind, either express or implied. The American Vision Institute does not make any claims or representations regarding the performance of the Power Vision Program except the opinions of the authors. 10. Governing Law. You acknowledge and agree that this agreement is governed by and construed in accordance with the laws of the State of Oregon, without giving effect to any conflict of laws or provisions contained in your state or country of residence. Any legal proceedings arising out of or relating to this agreement shall be subject to the exclusive jurisdiction of the courts of the State of Oregon. If for anyreason a court of the State of Oregon finds any portion of this Agreement to be unenforceable, the remainder of this Agreement shall remain in full force and effect.
